Do I need a breathalyser for summer 2012 holidays to France?

Arguably there is little point purchasing these time limited items for trips ending before 1st November 2012, since my understanding is that the law will be enacted on 1 July 2012 but will only be effective on 1 November 2012. i.e. there would be no penalty for not having a breathalyser until November.
The statement: "Stay legal when driving in France - New law comes into effect on the 1st of July, don't get caught out!" on the item listing is not the full story and is a bit misleading.

Prosecution of the law delayed again!
Was Nov 2012, then March 2013, now To-Be-Advised.

NB. There is little evidence yet on the www that this is the case (though the majority of sites offering advice have a vested interest in selling things to keep you legal, so no real surprise!). One reliable source, however, is the AA (Automobile Association, not Alcoholics Anomynous!) website which confirms that: although the law itself has not been removed, the prosecution of the law is indefinitely postponed. Remains a toothless regulation.

My interpretation of the situation would be:
A) If you want to stay completely legal whilst driving in France: buy and carry a breathalyser now.
B) If you're mainly interested in not being fined or prosecuted: Save your money for now, but check the current situation just prior to travelling to France.
